Wirtz Realty Corporation also reserves the right to add, delete, modify or change any portion of the web site, or to expand or restrict its use, as Wirtz Realty Corporation, in its sole and absolute discretion, shall determine, and without notice or liability to any past, present or future tenant, prospective tenant, visitor or user of the web site. The user agrees that he, she or it has no proprietary rights or ownership interest, in or to this web site, or with regard to the content or operation thereof, and that the past use of this web site does not grant to such user, any rights to any continued use thereof.

The violation of any terms or provisions contained within the “Terms and Conditions” portion of this web site shall result, without liability to Wirtz Realty Corporation, or notice, in (a) immediate termination of the license and rights to use or visit this web site, or to use any information contained therein; (b) the assertion and imposition of all rights, remedies and causes of action to which Wirtz Realty Corporation shall be entitled, in law or in equity, all of which being cumulative, and (c) to the extent permitted by law, entitlement to all costs, expenses and reasonable attorneys’ fees incurred by Wirtz Realty Corporation in connection with the enforcement of the rights conferred upon Wirtz Realty Corporation hereby or at law.

The Agreement as contained in the “Terms and Conditions” portion of this web site shall constitute the entire agreement between Wirtz Realty Corporation and any tenant, prospective tenant, visitor or user to this web site, with regard to the use and contents thereof, and shall supersede all prior agreements, understandings, negotiations or discussions, oral or written, expressed or implied, between the respective parties. No waiver of the exercise by Wirtz Realty Corporation of any provision or right as contained in this Agreement shall constitute a modification, whether expressed, implied, by custom and practice or course of dealings, of this Agreement, or a prohibition against subsequent exercise of either that, or any other, provision or right, whether contained herein or available by law or in equity.
